Terms of Service

1. Acceptance of Terms
By creating an account or using Notably, you agree to these Terms of Service. If you don't agree, please don't use the service.
2. Description of Service
Notably helps you organize the people you care about, receive reminders for important dates, draft personalized messages, and send physical handwritten cards. You may optionally include a third-party gift card (such as Visa, Amazon, Starbucks, or Target) with your handwritten card; gift cards are provided and honored by their respective issuers, and their terms and expiration policies apply. Notably may apply a small convenience fee on gift-card purchases, which is shown clearly before checkout.
3. User Accounts & Responsibilities
You're responsible for keeping your account credentials secure and for the accuracy of the information (including recipient addresses) you provide. You agree not to use Notably to send unlawful, harassing, or harmful content.
4. Payment, Subscriptions & Auto-Renewal
Ad-hoc card purchases are billed at the price shown at checkout. Circle subscriptions are billed in advance — monthly plans renew each month, and annual plans are billed once and renew each year — and automatically renew on the same schedule until you cancel. You can cancel anytime from your account; you will retain your Circle benefits (including any remaining included cards) through the end of the current paid period, after which no further charges will occur. We do not pro-rate refunds for the unused portion of a subscription period. Applicable sales tax, where required, is calculated and displayed at checkout.
5. Order Cancellation & Refunds
Because cards are handed off to our fulfillment partner shortly after purchase, you have a 2-hour cancellation window from the time the order is placed to cancel and receive a full refund from your account's order history. After the cancellation window closes, the card enters production and cannot be cancelled, changed, or refunded. Refunds for eligible cancellations are issued to your original payment method within 5–10 business days. Cards mailed but undelivered due to an incorrect address you provided are not eligible for a refund. If a card is lost by the postal service or arrives materially damaged, contact us within 30 days and we'll reprint or refund at our discretion.
6. Handwritten Card Fulfillment
Cards are produced and mailed by our third-party fulfillment partners, who act as sub-processors for order fulfillment. To fulfill your order we share only the information necessary — recipient name and address, your message, card selection, handwriting style, and any included gift card details. Delivery times depend on the United States Postal Service and other postal services and are not guaranteed. A current list of our sub-processors is available in our Privacy Policy.
7. Intellectual Property
You retain ownership of the messages and content you write. You grant Notably a limited license to store, transmit, and print your content solely to provide the service. Notably's brand, software, and design are our property.
8. Limitation of Liability
Notably is provided "as is." To the fullest extent permitted by law, we're not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the prior 12 months.
9. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms or misuse the service.
10. Changes to Terms
We may update these terms occasionally. If changes are material, we'll notify you by email or in-app before they take effect.
